MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF COTTONWOOD, ARIZONA, TO BE HELD October 2, 2018, AT 6:00 PM., AT THE COUNCIL CHAMBERS BUILDING, 826 NORTH MAIN STREET, COTTONWOOD, ARIZONA.

I.CALL TO ORDER
Mayor Elinski called the meeting to order at 6 p.m.
II.ROLL CALL
Council Members Present: Mayor Tim Elinski, Vice Mayor Kyla Allen, Council Members Deb Althouse, Tosca Henry, Ruben Jauregui, Linda Norman, and Karen Pfeifer.
III.PLEDGE OF ALLEGIANCE
Mayor Elinski led the pledge of allegiance.
IV.BRIEF SUMMARY OF CURRENT EVENTS BY MAYOR, CITY COUNCIL AND/OR CITY MANAGER -- THE PUBLIC BODY DOES NOT PROPOSE, DISCUSS, DELIBERATE OR TAKE LEGAL ACTION ON ANY MATTER BROUGHT UP DURING THIS SUMMARY UNLESS THE SPECIFIC MATTER IS PROPERLY NOTICED FOR LEGAL ACTION.
V.CALL TO THE PUBLIC--This portion of the agenda is set aside for the public to address the Council regarding an item that is not listed on the agenda for discussion. However, the Council cannot engage in discussion regarding any item that is not officially listed on the agenda for discussion and/or action (A.R.S. §38-431.02(H).) Comments are limited to a 5 minute time period.
Christopher Evans, from Cornville, asked the city to restrict weapons at the recreation center with secure lockers and adopt a policy requiring persons that bring guns into the rec center be required to secure those weapons.
VI.APPROVAL OF MINUTES

WORK SESSION OF SEPTEMBER 11, 2018; AND REGULAR MEETING OF SEPTEMBER 18, 2018
The Council approved the minutes as presented.
Comments regarding items listed on the agenda are limited to a 5 minute time period per speaker.
VII.UNFINISHED BUSINESS
6:05 P.M.1.ORDINANCE NUMBER 635--AMENDING THE CITY’S ZONING ORDINANCE BY DELETING SECTION 408. OUTDOOR LIGHTING CODE, IN ITS ENTIRETY AND ADDING A NEW SECTION 408. OUTDOOR LIGHTING; SECOND AND FINAL READING.
The Council unanimously approved Ordinance Number 635 amending the city's Zoning Ordinance by adopting a new outdoor lighting code in order to be dark sky compliant so the city can apply for Dark Sky City designation.  The effective date of this ordinance is November 3, 2018.
6:10 P.M.2.ORDINANCE NUMBER 646--AMENDING THE CITY'S ZONING ORDINANCE TO ALLOW RV PARKS AS CONDITIONAL USES IN THE GA (GENERAL AGRICULTURAL), CF (COMMUNITY FACILITY), AR-43 (AGRICULTURAL RESIDENTIAL) AND AR-70 (AGRICULTURAL RESIDENTIAL) ZONES; SECOND AND FINAL READING.
The Council unanimously approved Ordinance Number 646, amending the Zoning Ordinance to allow RV parks as a conditional use within GA (General Agricultural), CF ( Community Facility), AR-43 (Agricultural Residential), and AR-70 (Agricultural Residential) zones.  The effective date of this ordinance is November 3, 2018.

ORDINANCE NUMBER 648--AMENDING THE CITY'S ZONING ORDINANCE BY AMENDING SECTIONS 417. “MH” ZONE., MANUFACTURED HOME, D. PROPERTY DEVELOPMENT STANDARDS FOR MANUFACTURED HOME SUBDIVISIONS, 6. MINIMUM FRONT YARD, a.; AND 417. “MH” ZONE., MANUFACTURED HOME, E. PROPERTY DEVELOPMENT STANDARDS FOR MANUFACTURED HOME PARKS, 6. MINIMUM FRONT YARD, b.; SECOND AND FINAL READING.

The Council unanimously approved Ordinance Number 648, amending the Zoning Ordinance to further define setback requirements in the Manufactured Home zone.  The effective date of this ordinance is November 3, 2018.
6:20 P.M.4.ORDINANCE NUMBER 649--AMENDING THE CITY’S ZONING ORDINANCE BY AMENDING ARTICLE II. DEFINITIONS, BY ADDING A NEW DEFINITION, “LOT, CORNER”; AND SECTION 404. GENERAL PROVISIONS., 6. SWIMMING POOLS AND DETACHED ACCESSORY BUILDINGS., c. DETACHED ACCESSORY BUILDINGS IN RESIDENTIAL ZONES, (1); SECOND AND FINAL READING.
The Council unanimously approved Ordinance Number 649, amending the Zoning Ordinance to define corner lot and add requirements for accessory structures on corner lots.  The effective date of this ordinance is November 3, 2018.
6:25 P.M.5.ORDINANCE NUMBER 650--ADOPTING THE COTTONWOOD ENGINEERING DESIGN STANDARDS MANUAL; SECOND AND FINAL READING.
The Council unanimously approved Ordinance Number 650, adopting the Cottonwood Engineering Design Standards Manual.  The effective date of this ordinance is November 3, 2018.
VIII.NEW BUSINESS—The following items are for Council discussion, consideration, and possible legal action.
6:30 P.M.1.ORDINANCE NUMBER 651--AMENDING THE ZONING MAP OF THE CITY OF COTTONWOOD FOR TWO PARCELS OF LAND APPROXIMATELY .82 ACRES LOCATED AT 1010 SOUTH MAIN STREET(SOUTHWEST CORNER OF STATE ROUTES 89A AND 260) TO BE RECLASSIFIED FROM C-2 (HEAVY COMMERCIAL) AND PUD/C (PLANNED UNIT DEVELOPMENT COMMERCIAL) TO PAD (PLANNED AREA DEVELOPMENT); FIRST READING

The Council held the first reading of Ordinance Number 651 to rezone two adjoining parcels of land located at 1010 S. Main Street from C-2 (Heavy Commercial) and PAD (Planned Area Development) to PAD (Planned Area Development) for the proposed new Starbucks.

 

The second and final reading will be held on October 16, 2018.

6:45 P.M.2.RESOLUTION NUMBER 2960--DECLARING AMENDED TITLE 1 - GENERAL PROVISIONS; AMENDED TITLE 2 - ADMINISTRATION AND PERSONNEL; AND AMENDED TITLE 3 - REVENUE AND FINANCE; OF THE COTTONWOOD MUNICIPAL CODE TO BE PUBLIC RECORDS.

The Council unanimously approved Resolution Number 2960 declaring the amended Title 1 - General Provisions, Title 2 - Administration and Personnel, and Title 3 - Revenue and Finance

of the city's Municipal Code a public record.

6:50 P.M.3.ORDINANCE NUMBER 644--AMENDING TITLE 1 - GENERAL PROVISIONS; TITLE 2 - ADMINISTRATION AND PERSONNEL; AND TITLE 3 - REVENUE AND FINANCE; OF THE COTTONWOOD MUNICIPAL CODE; FIRST READING.

The Council held the first reading of Ordinance Number 644, which amends Title 1 - General Provisions, Title 2 - Administration and Personnel, and Title 3 - Revenue and Finance of the Cottonwood Municipal Code.

 

The second and final reading will be held on October 16, 2018.

IX.CLAIMS AND ADJUSTMENTS
The Council unanimously approved the claims and adjustments as presented.
X.ADJOURNMENT

Notice is hereby given that pursuant to A.R.S. 1-602.A.9 , subject to certain specified statutory exceptions, parents have a right to consent before the State or any of its political subdivisions make a video or audio recording of a minor child. Meetings of the City Council are audio and/or video recorded, and, as a result, proceedings in which children are present may be subject to such recording. Parents in order to exercise their rights may either file written consent with the City Clerk to such recording, or take personal action to ensure that their child or children are not present when a recording may be made. If a child is present at the time a recording is made, the City will assume that the rights afforded parents pursuant to A.R.S. 1-602.A.9 have been waived.
